Terms of Service

1. Nature of the Service — Material Notice

Zohar is a service for entertainment, inspiration, and self-reflection based on mystical traditions: astrology, numerology, and tarot cards, along with a chat with an AI-based advisor character ("Content"). The Content is for entertainment and personal interest only. The readings, interpretations, and responses in the Service:

• are not based on scientific evidence and do not purport to be accurate, correct, or predictive;
• do not constitute professional advice of any kind — medical, mental-health, psychological, legal, financial, investment, or otherwise;
• are not a substitute for consulting a qualified professional;
• should not be relied upon in making meaningful decisions in your life.

2. Age and Capacity

The Service is intended for adults only — persons aged 18 and over. By using the Service, you represent and confirm that:

• you are at least 18 years old;
• you have the legal capacity to enter into a binding contract;
• all information you provide is true and accurate.

3. Account and Authentication

• Authentication is passwordless — via a one-time link sent to your email ("magic link" / OTP), and in the future via passkeys.
• You are responsible for maintaining secure access to your email inbox. Any action taken via a valid authentication link will be attributed to you.
• Do not share access to your account, and do not use another person's account.

4. Products and Payments

The Service offers the following products (pricing is in US Dollars, USD):

4.1 Payment Processing — Merchant of Record

Important: Payment processing is handled by an external provider, Gumroad, acting as Merchant of Record (MoR). This means:

• Gumroad is the formal "seller" of record for the transaction, collects payment, issues invoices, and collects/remits applicable VAT and sales taxes.
• The Operator does not collect, handle, or store your credit card details — these are handled entirely by Gumroad.
• The transaction is also subject to Gumroad's terms and privacy policy.

4.2 Recurring Subscription

The subscription is a recurring transaction:

• It renews automatically monthly and you will be charged accordingly until cancelled.
• You may cancel at any time — as easily as you subscribed, or by contacting zoharmistic@gmail.com. Cancellation takes effect within 3 business days of notice (or a later date you choose).
• You will not be charged for cycles after cancellation takes effect.

5. License and Restrictions

We grant you a personal, limited, non-exclusive, non-transferable license to use the Service for private, non-commercial purposes only. You may not:

• use the Service for any unlawful purpose or in breach of these Terms;
• copy, reproduce, distribute, sell, or commercially exploit the Content or any part of the Service;
• reverse-engineer, decompile, or attempt to extract source code;
• use bots, scraping, or unauthorized automated access;
• attempt to bypass technical limits, security, or billing mechanisms;
• submit offensive, threatening, or infringing content;
• impersonate any person or entity.

6. Intellectual Property

All rights in the Service — including design, code, logo, the "Zohar" name, texts, original illustrations (including original tarot artwork), and original Content — belong to the Operator or its licensors and are protected by intellectual property laws.

Tarot card meanings are based on the public-domain Rider-Waite-Smith tradition; the illustrations in the Service are original and protected.

Content generated for you (personal readings) may be saved and used for your personal use only.

7. AI-Generated Content

• Some Content, particularly the live chat, is generated automatically by an AI model. You acknowledge and agree to this.
• Mystical data is computed deterministically in code; the language model phrases it.
• An AI model may produce incorrect, inaccurate, inconsistent, or inappropriate information. Do not treat such Content as fact, diagnosis, or recommendation.
• Do not enter sensitive information in chat (health, mental-health, financial, or identifying details of third parties). See the AI Processing Addendum and Privacy Policy.

8. Limitation of Liability and Disclaimer of Warranties

To the maximum extent permitted by law:

• The Service and Content are provided "AS IS" and "AS AVAILABLE", without any representation or warranty of any kind, express or implied.
• We do not warrant that the Service will be uninterrupted, error-free, or that the Content will be accurate, complete, or fit for your needs.
• We will not be liable for any damage — direct, indirect, consequential, special, or punitive — arising from use of the Service or reliance on the Content, including (without limitation) decisions made based on readings, loss of profit, distress, or third-party harm.
• In any event, our total aggregate liability to you will not exceed the amount you actually paid for the Service in the 12 months preceding the event — or $50, whichever is higher.
• The Operator's liability does not extend to third-party services (Gumroad, infrastructure providers, etc.), which are subject to their own terms.

Nothing herein derogates from rights that cannot be contracted out of under applicable law, including mandatory consumer rights, which these Terms do not waive.

9. Indemnification

You agree to indemnify the Operator and those acting on its behalf against any damage, loss, expense, or claim (including reasonable legal fees) arising from your use of the Service in breach of these Terms, violation of law, or infringement of third-party rights.

10. Suspension and Termination

• We may suspend, block, or terminate your access, in whole or part, at any time, if you breach these Terms or the law, or for security/operational reasons.
• You may stop using the Service and close your account at any time. Closing an account does not entitle you to a refund, except as set out in the Refund Policy.
• Provisions meant by their nature to survive termination (IP, limitation of liability, indemnification, governing law) will continue to apply.

11. Changes to the Terms and Service

We may update these Terms from time to time. Material changes will be posted in the Service and, where possible, notified by email. Continued use after an update constitutes acceptance. We may change, add, or discontinue features.

12. Governing Law and Jurisdiction

• These Terms and use of the Service are governed by the laws of the State of Israel, without its conflict-of-law rules.
• Exclusive jurisdiction lies with the competent courts of Tel Aviv-Yafo, Israel.
• Notice to EU consumers: Nothing herein deprives you of mandatory rights granted under the law of your country of residence, where applicable, including the right to bring proceedings in your own country.

13. General

• Assignment: You may not assign your rights. The Operator may assign.
• Waiver: A waiver of one breach is not a waiver of future breaches.
• Severability: If a provision is unenforceable, the rest remain in effect.
• Entire agreement: These Terms, together with the accompanying documents (Privacy Policy, Refund Policy, Disclaimer, AI Addendum), constitute the entire agreement between you and the Operator.
• Language: In any conflict between the Hebrew and English versions — the Hebrew version prevails.
